FarmHub Terms & Conditions

 

These Terms & Conditions (“Terms”) govern the access and use of the FarmHub platform, including the website, mobile application, and all related services (“Platform”). By accessing, browsing, or transacting on FarmHub, you (“User”) agree to abide by these Terms. If you do not agree, please refrain from using the Platform.

 

1. Definitions

 

For the purpose of this document:

  • “Platform” – FarmHub ecommerce platform managed by FarmHub Society.

  • “Customer/User” – Any person accessing, browsing, or purchasing from FarmHub.

  • “Seller/Farmer” – Any individual, farmer, or business selling products on FarmHub.

  • “Products” – Any goods, including farm produce, groceries, or related items listed for sale.

  • “Order” – A purchase request placed by a Customer on FarmHub.

  • “Policy” – Refers to FarmHub’s specific policies (Product Listing, Pricing, Cancellation, Shipping, Refund, Privacy, etc.).

 

2. Eligibility to Use

​

  • Users must be at least 18 years of age to register and transact.

  • Minors may use the Platform under parental/guardian supervision, who will be responsible for all actions.

  • Sellers/farmers must meet FarmHub Seller Onboarding Policy requirements.

 

3. Account Registration & Responsibilities

​

  • Users must create an account using valid and accurate details.

  • Users are responsible for safeguarding login credentials.

  • Any activity conducted through the registered account will be treated as the account holder’s responsibility.

  • FarmHub reserves the right to suspend or terminate accounts in case of suspicious, fraudulent, or unlawful activity.

 

4. Permitted Use of the Platform

​

  • The Platform may be used only for lawful purposes.

  • Prohibited actions include:

    • Fraudulent orders or chargeback misuse.

    • Sale/purchase of prohibited or counterfeit goods.

    • Misuse of content (copying, scraping, reverse engineering).

    • Spamming, harassment, or harmful activities.

  • Violations may result in permanent suspension and legal action.

 

5. Product Listings, Pricing & Availability

​

  • Product descriptions, images, and prices are provided by Sellers/Farmers.

  • FarmHub ensures monitoring but cannot guarantee that listings are error-free.

  • Prices may fluctuate due to market conditions; the final price is confirmed at checkout.

  • Certain products may be subject to legal restrictions (e.g., FSSAI compliance for food items).

  • Availability is subject to stock; FarmHub may cancel or reject orders in case of stock unavailability.

 

6. Order Placement & Acceptance

​

  • An order placed on FarmHub constitutes an offer to purchase.

  • FarmHub/Sellers reserve the right to accept or reject any order.

  • Orders are confirmed only after successful payment and seller acceptance.

  • In case of rejection or cancellation, any pre-paid amount will be refunded as per the Refund Policy.

 

7. Payments

​

  • Payments must be made via approved FarmHub payment gateways.

  • All transactions are secure and encrypted.

  • FarmHub does not store sensitive payment information (e.g., card details).

  • Users must ensure sufficient balance/credit in chosen payment methods.

  • Failed transactions will not bind FarmHub or Sellers to fulfill orders.

 

8. Shipping, Delivery & Risk of Loss

​

  • Shipping and delivery timelines are governed by the Shipping & Delivery Policy.

  • Risk of loss or damage to goods passes to the customer upon delivery.

  • Customers must inspect the product at the time of delivery and report issues immediately.

  • Delays due to natural calamities, strikes, or unforeseen events will not hold FarmHub liable.

 

9. Cancellations, Returns & Refunds

​

  • Customers may cancel orders within the timeframes defined in the Order & Cancellation Policy.

  • Returns/refunds are subject to the Return & Refund Policy.

  • Certain items such as perishables, personalized products, or clearance items may not be eligible for return.

  • Refunds will be processed within 5–10 working days depending on the payment method.

 

10. Seller & Farmer Obligations

​

  • Sellers must:

    • Provide genuine, high-quality, and compliant products.

    • Accurately describe products (weight, quantity, ingredients, expiry date).

    • Ensure proper packaging and timely dispatch.

    • Comply with all FarmHub Policies and applicable Indian laws.

  • Sellers are solely responsible for product quality and compliance with regulations (FSSAI, GST, etc.).

 

11. Intellectual Property Rights

​

  • All logos, branding, images, software, and content on FarmHub belong to FarmHub or its licensors.

  • Users are prohibited from copying, distributing, or misusing FarmHub content.

  • Sellers must ensure they do not infringe third-party copyrights, trademarks, or patents.

 

12. Privacy & Data Protection

​

  • FarmHub collects and processes data as per the Data Privacy & Security Policy.

  • Users consent to the use of their data for order processing, logistics, and communications.

  • FarmHub ensures compliance with IT Act, 2000 and related data protection guidelines.

 

13. Limitation of Liability

​

  • FarmHub acts as an intermediary and is not the manufacturer of products.

  • FarmHub shall not be liable for:

    • Product quality or safety issues (responsibility of Seller).

    • Delays caused by third-party logistics.

    • Losses caused by user negligence in safeguarding accounts.

  • FarmHub’s liability, in any case, shall not exceed the value of the transaction in dispute.

 

14. Indemnification

​

  • Users agree to indemnify FarmHub against claims, damages, or losses arising from:

    • Breach of these Terms.

    • Violation of laws/regulations.

    • Misuse of the Platform.

 

15. Compliance with Laws

​

  • All Users, Sellers, and Customers must comply with applicable Indian laws including:

    • Consumer Protection Act, 2019

    • GST Act, 2017

    • FSSAI Regulations (for food items)

    • Legal Metrology Act

    • IT Act, 2000

  • Any violation may lead to suspension, termination, or legal proceedings.

 

16. Prohibited Products

​

Sellers are strictly prohibited from listing:

  • Illegal drugs, alcohol, or tobacco products.

  • Hazardous chemicals or explosives.

  • Counterfeit or pirated goods.

  • Products banned under Indian law.

 

17. Dispute Resolution

​

  • FarmHub encourages resolution through Customer Support & Grievance Policy.

  • If unresolved, disputes shall be governed by the laws of India.

  • Jurisdiction shall lie exclusively with the courts of Karimnagar, Telangana India.

 

18. Termination of Services

​

  • FarmHub may suspend or terminate access if:

    • User violates these Terms or any FarmHub Policy.

    • Fraudulent, illegal, or suspicious activity is detected.

    • FarmHub is required to do so by law or government authority.

 

19. Changes to Terms

​

  • FarmHub reserves the right to update or modify these Terms at any time.

  • Continued use of the Platform after changes implies acceptance of the updated Terms.
